Trademark checks

How MyDesigns checks your designs for trademark conflicts, and what it covers.

Trademark checks overview

MyDesigns compares the text on your designs, such as titles, tags and descriptions, against registered trademarks and flags any word or phrase that conflicts with one. You can check designs in bulk, or look up a single keyword before you use it.

What we check against

Source
Trademarks registered with the United States Patent and Trademark Office (USPTO). Our trademark database downloads new USPTO filings every day.
Region
United States only. International and other national registries, such as the EUIPO or WIPO, are not checked.
Status
Live trademarks only. Dead marks, such as abandoned, cancelled or expired ones, are left out because they no longer protect anything.
Classes
The goods and services classes most relevant to print on demand. Marks registered only in other classes are not reported.

Classes we cover

Every trademark is registered for specific kinds of goods, grouped into numbered international classes (the Nice classification). A mark only protects the classes it is registered in, so the check looks at the classes that cover products you can sell through MyDesigns.

9Phone cases, laptop sleeves, mouse pads
18Bags, totes, backpacks, wallets
20Home decor such as pillows, cushions and frames
21Mugs, tumblers, drinkware and kitchenware
24Blankets, towels and other textiles
25Clothing such as t-shirts, hoodies and hats

Checking your designs

On the Designs page, select the designs you want to check, open the Trademarks actions and choose Check trademarks. The check runs in the background, so you can keep working while it finishes.

Each filled-in field on a selected design is checked: title, description, tags and any other field in the collection template. Empty fields are skipped.

When a conflict is found, it appears on the design under Found trademarks, and the matching words are highlighted inside the fields they appear in. Matching ignores case and only counts whole words or phrases, so a short mark is not flagged just because it is part of a longer word.

After you rewrite the flagged text, select Clear all warnings to remove the flags from the design. This clears every flag on that design at once, so run the check again afterwards to confirm the new text is clean.

Searching a keyword

To test a word or phrase before you use it, choose Search trademarks from the Trademarks actions on the Designs page. Enter the keyword and select Check.

Any conflicting live trademarks are listed with their serial number, status, filing date and registration date. The serial number links to the full record on the USPTO website. If nothing conflicts, you will see that the keyword is safe to use.

Trademarks in Scout AI

Scout AI has its own Trademark protection setting. When it is on, Scout screens each niche before researching it and skips anything that fails, so a trademarked idea never reaches the generation step. Titles, descriptions and tags Scout writes for you are checked as well.
