This Privacy Policy explains how MyDesigns, Inc. ("MyDesigns," "we," "us," or "our") collects, uses, shares, and protects personal information in connection with the mydesigns.io website, applications, and related products and services (the "Services"). It also describes your privacy rights and how to exercise them. Our use of cookies and similar technologies is described in our Cookie Policy.

This Policy does not apply to the practices of third parties we do not control, including the sales channels, payment providers, and other services you connect to the Services.

Our role

When we process information to provide and operate the Services to you (our user), we act as a controller of that information. When you use the Services to sell to your own customers, you are the controller of your customers' personal information, and we process it on your behalf as a processor or service provider. You are responsible for providing your customers with any required privacy notices and for having a lawful basis for the data you collect from them.

1. Information we collect

Information you provide:

• Account and profile - name, email address, username, password, business details, and country.
• Billing information - your billing contact details and the payment method you use. Payment-card details are collected and processed by our payment processor over a secure, PCI-compliant connection; we do not store full card numbers on our systems.
• User Content - designs, images, artwork, text, prompts, and other materials you upload to or generate through the Services.
• Communications - messages, support requests, survey responses, and feedback.

Information collected automatically:

• Device and usage data - IP address, device and browser type, operating system, referring pages, pages viewed, features used, search terms, access times, and similar analytics.
• Cookies and similar technologies - as described in the Cookie Policy.

Information from third parties:

• Connected sales channels and integrations (such as Etsy, Shopify, WooCommerce, or TikTok Shop) - order and listing information necessary to provide the Services.
• Payment processor and fraud-prevention providers - transaction status and risk signals.
• Advertising and analytics partners - engagement and attribution data.
• Social or single-sign-on providers, if you choose to connect them.

2. How we use information

We use personal information to: create and manage accounts; provide, operate, and improve the Services; process and route orders and fulfillment; process payments and manage the MyDesigns Wallet; operate AI features such as Dream (see Section 3); provide customer support; personalize and improve the user experience; communicate with you, including administrative and, where permitted, marketing messages; detect, prevent, and investigate fraud, abuse, and security incidents; comply with legal obligations and enforce our terms and policies; and operate our business, including analytics and aggregated reporting.

Legal bases (where GDPR/UK GDPR applies). We process personal information as necessary to perform our contract with you, to comply with legal obligations, for our legitimate interests (such as securing and improving the Services and preventing fraud) where not overridden by your rights, and with your consent where required (such as for certain marketing and cookies).

3. AI features and Dream

When you use AI features such as Dream, we process the inputs you provide (including prompts and any images you upload) and the outputs generated in order to provide the feature. These inputs and outputs may be processed by our AI service providers acting on our behalf and subject to confidentiality and data-protection obligations. We do not use your private User Content or AI inputs to train publicly available third-party AI models without your consent. You are responsible for the inputs you provide and your use of AI outputs, as described in the Terms of Service.

4. How we share information

We share personal information only as described here. We do not sell your personal information for money. We work with the following categories of service providers, who process information on our behalf under appropriate confidentiality and data-protection obligations:

• Hosting, infrastructure, and security providers that host and protect the Services.
• Payment processing and fraud prevention providers (such as Stripe) that process payments and assess risk.
• Printing, manufacturing, fulfillment, and logistics providers (our Print Providers, such as SwiftPOD and Monster Digital, and shipping carriers) that produce and deliver Products. We share only the information needed to fulfill and ship an order.
• Email, messaging, and customer-support providers.
• Analytics and advertising providers (see Section 5).

We may also share information: with sales channels and integrations you connect, as needed to provide the Services; to comply with law or valid legal requests, and to protect the rights, property, and safety of MyDesigns, our users, or others; in connection with a merger, acquisition, financing, or sale of assets (a "business transfer"), subject to this Policy; and with your consent or at your direction.

5. Advertising and analytics

We and our partners use cookies and similar technologies to measure and improve the Services and to deliver and measure advertising, which may include interest-based or cross-context behavioral advertising. Depending on your jurisdiction, this activity may be considered "sharing" or a "sale" of personal information under applicable law. You can exercise choices about this activity through the Cookie Policy and the controls described in Section 9, including any "Do Not Sell or Share My Personal Information" control we provide. We honor recognized opt-out preference signals (such as Global Privacy Control) where required.

6. International data transfers

We operate globally and may transfer, store, and process your information in countries other than your own, including the United States, which may have different data-protection laws. Where we transfer personal information from the European Economic Area, the United Kingdom, or Switzerland, we use appropriate safeguards, such as the European Commission's Standard Contractual Clauses, where required.

7. Data retention

We retain personal information for as long as needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Retention periods vary by the type of information and the purpose for which it is processed. When information is no longer needed, we delete or de-identify it. We may retain aggregated or de-identified information that no longer identifies you.

8. Security

We use technical and organizational measures designed to protect personal information, including encryption in transit and access controls. Payment-card data is handled by our PCI-compliant payment processor and is not stored on our systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

9. Your privacy rights

Depending on where you live, you may have some or all of the following rights regarding your personal information: to access and obtain a copy of it; to correct inaccuracies; to delete it; to port it to another provider; to object to or restrict certain processing; to withdraw consent; and to opt out of targeted/cross-context behavioral advertising and any "sale" or "sharing" of personal information. We will not discriminate against you for exercising these rights.

To exercise your rights, contact us at legal@mydesigns.io or through your account settings, where available. We will verify your request as required by law and respond within the applicable timeframe. You may use an authorized agent where permitted; we may require proof of authorization. If we deny a request, you may appeal as described in our response.

United States state privacy rights. If you are a resident of California or another U.S. state with a comprehensive privacy law, you have the rights described above to the extent they apply in your state, including the right to know the categories of personal information we collect, use, disclose, and (where applicable) share; the right to access, correct, and delete; the right to opt out of the "sale" or "sharing" of personal information and of targeted advertising; and the right to limit the use of sensitive personal information. We do not knowingly sell personal information for money, and we do not use or disclose sensitive personal information for purposes other than those permitted. To opt out of "sharing" for cross-context behavioral advertising, use the controls described in Section 5.

EEA/UK rights. If you are in the EEA or UK, you also have the right to lodge a complaint with your local data-protection authority.

10. Children's privacy

The Services are intended for users 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us personal information, contact us and we will delete it.

11. Changes to this Policy

We may update this Policy from time to time. We will revise the "Last updated" date and, where a change is material, provide additional notice by reasonable means. Your continued use of the Services after a change takes effect constitutes acceptance of the updated Policy.
