DMCA & Copyright Policy

MyDesigns, Inc. ("we," "our," or "us") respects the intellectual property rights of others and expects the sellers ("Sellers") using our platform and storefronts to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using the MyDesigns platform that are reported to our Designated Copyright Agent.

1. Notification of Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, and you believe in good faith that any content hosted on a MyDesigns-powered storefront infringes upon your copyrights, please submit a DMCA Takedown Notice to our Designated Agent containing the following information:

A Physical or Electronic Signature: The signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.

Identification of the Copyrighted Work: A clear description or a link to the original copyrighted work claimed to have been infringed.

Identification of the Infringing Material: Information reasonably sufficient to permit MyDesigns to locate the material you claim is infringing (e.g., the specific URL of the product page on the Seller's store).

Contact Information: Your address, telephone number, and email address.

Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

Statement of Accuracy: A statement made under penalty of perjury that the information provided in the notification is accurate and that you are the copyright owner or authorized to act on their behalf.

Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to legal liability and damages.

2. Counter-Notification Procedures

If a Seller believes that their content was removed (or access to it was disabled) by mistake or misidentification, the Seller may submit a Counter-Notice to our Designated Agent at legal@mydesigns.io. The Counter-Notice must contain:

The Seller's physical or electronic signature.

Identification of the material that has been removed and the location (URL) at which the material appeared before it was removed.

A statement under penalty of perjury that the Seller has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

The Seller's name, address, telephone number, and email address.

A statement that the Seller consents to the jurisdiction of the Federal District Court for the judicial district in which their address is located (or Clark County, Nevada if the Seller's address is outside the United States), and that the Seller will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid Counter-Notice, MyDesigns will forward it to the original complaining party. If the original complaining party does not notify MyDesigns within 10 business days that they have filed a legal action seeking a court order against the Seller, we may restore the removed content.

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, MyDesigns has adopted a strict policy of terminating, in appropriate circumstances and at our sole discretion, the accounts and storefronts of Sellers who are deemed to be repeat infringers. MyDesigns may also, at its sole discretion, limit access to the platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

4. Platform Disclaimer

MyDesigns acts purely as a technology infrastructure and print-on-demand routing service. We do not pre-screen, manually review, or approve the designs uploaded by independent Sellers to their storefronts. Sellers bear sole liability for the content they publish.
