1. Introduction and Philosophy

MyDesigns ("we," "our," or "us") provides a platform designed to empower creators, designers, and entrepreneurs to build their brands and sell their products. We believe in free expression and the power of independent commerce. However, to ensure a safe, legally compliant, and trusted environment for both sellers and buyers, all users must adhere to this Acceptable Use Policy ("AUP").

By creating a storefront or using any MyDesigns services, you (the "Seller") agree to comply with this AUP. Because we utilize Stripe for payment processing, you are also bound by the Stripe Restricted Businesses Policy.

2. Prohibited Content and Products

You may not use the MyDesigns platform to publish, promote, or sell any products (physical or digital) that fall into the following categories:

Illegal Activity and Regulated Goods:

Products that promote, facilitate, or instruct others on how to engage in illegal acts.

The sale of regulated goods, including but not limited to firearms, ammunition, weapons, explosives, tobacco, e-cigarettes, drugs, drug paraphernalia, or heavily regulated medical devices.

Hate Speech and Discrimination:

Content that promotes, incites, or glorifies violence, hatred, or discrimination against individuals or groups based on race, ethnicity, national origin, religion, sexual orientation, gender identity, age, or disability.

Products featuring hate group iconography, slurs, or historical items that glorify crimes against humanity.

Violence, Gore, and Self-Harm:

Content that promotes, glorifies, or provides instructions on self-harm or suicide.

Extremely graphic, violent, or gory imagery that serves no educational, artistic, or newsworthy purpose.

Threats of violence or harassment directed at specific individuals or organizations (doxxing, bullying, or blackmail).

Explicit Content and Obscenity:

Sexually explicit content, pornography, or products that depict non-consensual sexual content. (Note: Artistic nudity or mature themes may be permitted at our discretion, provided they do not violate our print partners' capabilities or Stripe's financial restrictions, but explicit pornographic material is strictly banned).

Deceptive Practices and Fraud:

Scams, pyramid schemes, or multi-level marketing (MLM) materials.

Products that make false, misleading, or unproven health or medical claims (e.g., "miracle cures").

Deceptive digital products or software containing malware, viruses, trojan horses, or any code designed to disrupt or gain unauthorized access to computer systems.

Intellectual Property Infringement:

Products that violate the copyrights, trademarks, right of publicity, or other intellectual property rights of any third party. (Please refer to our DMCA Policy for specific reporting and enforcement procedures).

3. Digital Product Specific Rules

When selling digital products via MyDesigns, you agree that you will not:

Sell stolen accounts, cracked software, or access keys obtained illegally.

Use the platform to distribute spam or mass unsolicited communications.

Sell digital items that require the buyer to visit a separate, unverified third-party platform to access the core value of their purchase (phishing risks).

4. Platform Integrity and Security

You may not use MyDesigns in any way that compromises the stability or security of the platform. This includes:

Attempting to bypass, exploit, or disable any security features, licensing systems, or payment gateways.

Using automated bots, scrapers, or scripts to extract data from MyDesigns or its storefronts without explicit written permission.

Artificially inflating sales metrics, manipulating reviews, or engaging in "friendly fraud" (purchasing your own products to manipulate rankings).

5. Enforcement and Repercussions

MyDesigns reserves the right, at our sole and absolute discretion, to determine whether a product, design, or storefront violates this AUP. We are not obligated to actively monitor all content, but we will take action upon discovery or receipt of a valid report.

If we determine that you have violated this AUP, we may take any of the following actions without prior notice:

Remove specific products or designs from your Store.

Temporarily suspend your access to the MyDesigns platform.

Permanently terminate your account and storefront.

Hold or delay payouts in your Stripe Express account to cover potential chargebacks, refunds, or legal liabilities arising from your violation.

Report illegal activities to the appropriate law enforcement authorities.

6. Reporting Violations

If you encounter a storefront or product that you believe violates this AUP, please report it to us immediately at legal@mydesigns.io.
